In Virginia, except in certain limited circumstances, pedestrians have to look out for themselves. They do not have the right of way. Some exceptions occur in marked crosswalks but even that exception is somewhat limited. If you are injured as a pedestrian the insurance company for the person that hit you may deny liability in all but the clearest of liability cases.

As a pedestrian you do not have any protection from impact. You do not have a seat belt or airbag. You are not surrounded by several thousand pounds of metal and plastic. Even the most minor of impacts with your body can lead to very serious injuries.

Before you discuss your case and the accident with the insurance company you should get the advice of experienced counsel. We will be glad to help. At our firm, the first consultation for a personal injury case is free. For more information call 1 (800) 201-9987 or (434) 332-5155 or fill out a consultation form here.
